We serve German and foreign clients in all needs of development, structuring, financing, production and exploitation of national and international cinematographic works (TV-movies and series as well as webisodes regarding motion pictures, documentaries and live action films to the point of CGI and 3D-productions) as well as their out-of-court and judicial enforcement. The project-specific counsel also extends, in this connection, to the economical aspects of an optimized financing, production and exploitation structure for audio-visual and other immaterial assets. Furthermore, we assist with the financing and interim-financing contracts of the productions, the negotiations of film insurance, errors & omissions and completion bond contracts, the structuring of profit distribution and recoupment plans as well as the closing of collection account management agreements.
A further core-competency lies in the counseling of international co-productions including their structuring and financing and in consideration of cross-national film agreements as well as national specifications. We advise in the areas of classic exploitation of AV-productions and regarding the 360° exploitation of contents, concepts and ideas and the comprehensive advertisement and exploitation in the internet and assist by means of mobile devices. We advise clients from all areas of the film and TV industry. These include film and TV producers, service-providers, distribution companies, banks, financiers, investors, film promotion institutes, insurance companies and, of course, last but not least, authors, directors, actors and actresses and other film professionals. Finally, we advise in close agreement with the Practice Group corporate and tax law in regard to acquisitions and share holding, particularly in view of due diligence of existing assets in the area of immaterial assets.
